Supreme Court upholds the constitutional validity of the notification of provisions relating to insolvency and bankruptcy of personal guarantors
Recently, a two-judge bench of the Supreme Court of India upheld the constitutional validity of the notification bringing into effect certain provisions of the Insolvency and Bankruptcy Code, 2016 with respect to personal guarantors of corporate debtors.
